Issue    

A major manufacturer of specialty chemicals required expert services in addressing environmental liabilities of seven discrete solid waste management units (SWMUs) throughout the facility as well as a sitewide SWMU involving petroleum hydrocarbon contamination. 

Solution

Our initial assessment and investigation addressed the seven individual SWMUs and an eighth sitewide SWMU. We conducted a RCRA facility assessment of the individual SWMUs. Based on soil, surface water, and sediment investigations, we determined that “No Further Action” was necessary for two SWMUs and that four SWMUs required further investigation and remediation. The seventh SWMU, a stormwater system, required corrective measures to prevent petroleum product from entering the sewer system and discharging to surface waters. The eighth SWMU required sitewide investigations of petroleum contamination.  Following groundwater and soil investigations and baseline ecological health evaluations, we provided expert testimony and technical services on behalf of our client for litigation support to hold the former property owner responsible for petroleum-related contamination at the site.

Through our litigation support we helped our client win a settlement to recover costs and force the former property owner to remove all petroleum-related contamination at the site. We continue to monitor the ongoing remediation.
